Samsung Apple Rubber Band Patent Retrial
Trying to get a retrial for infringing upon Apple’s famous “rubber band” design patent was too much of a stretch for Samsung. CNET reports that Judge Lucy Koh has denied Samsung’s request for a new trial to decide whether the company infringed upon Apple’s ’381 patent that describes the bouncy “rubber band” effect that occurs when scrolling on Apple devices. Koh has granted Samsung a new trial to recalculate the damages that it owes Apple for its assorted patent infringements after she also reduced Apple’s award in the trial by around $ 450 million. Samsung has also been found guilty of infringing upon the ’381 patent in Japan, so its hope of getting away scot-free in this particular case are pretty slim.
